End-User License Agreement (EULA)

Please read this End-User License Agreement (“Agreement”) carefully before clicking the “I Agree” button, downloading, or using the Herbal IQ application.

Interpretation and Definitions

Definitions:

• Agreement: refers to this EULA between You and Herbal IQ.
• Application: means the Herbal IQ software available via the Apple App Store or Google Play.
• Application Store: refers to Apple’s App Store or Google Play Store.
• Company: also referred to as “We”, “Us”, or “Our” refers to Herbal IQ, 6300 Transit Rd, Depew, NY 14043.
• Content: includes text, images, data, and other information you upload or share.
• Country: refers to the United States.
• Device: means any mobile or digital device used to access the Application.
• You: refers to the individual or legal entity using the Application.

Acknowledgment

By using the Application, You agree to be bound by this Agreement. If you do not agree, do not install or use the Application.

This Agreement is solely between You and Herbal IQ, not with the Application Store. The Application Store may enforce this Agreement as a third-party beneficiary.

License

Herbal IQ grants You a revocable, non-exclusive, non-transferable, limited license to use the Application on a Device owned or controlled by You.

You may not:
– Sell, rent, distribute, or sublicense the Application.
– Modify, reverse engineer, or decompile the Application.
– Use the Application for any unlawful or commercial purposes not authorized in this Agreement.

Content

You are responsible for all content and activity under your account. Prohibited content includes but is not limited to:
– Illegal or harmful material.
– Infringing intellectual property.
– Malicious code or spam.
– False or misleading content.

Herbal IQ may moderate or remove inappropriate content.

Intellectual Property

All intellectual property related to the Application is owned by Herbal IQ. No rights are transferred except for the limited license granted herein.

Feedback

Suggestions or feedback submitted by You may be used by Herbal IQ without obligation to compensate or credit You.

Modifications and Updates

Herbal IQ may modify, suspend, or discontinue the Application at any time. Updates may be automatically installed and subject to this Agreement.

Third-Party Services

The Application may provide access to third-party services or websites. Herbal IQ is not responsible for third-party content, and You use such services at your own risk.

Privacy Policy

Use of the Application is subject to Herbal IQ’s Privacy Policy, available at: https://herbaliq.org/privacy-policy

Termination

This Agreement remains in effect until terminated by You or Herbal IQ. You may terminate it by deleting the Application. Herbal IQ may terminate it at any time with or without notice.

Indemnification

You agree to indemnify and hold Herbal IQ harmless from any claims or liabilities arising from your use of the Application or violation of this Agreement.

No Warranties

The Application is provided “AS IS” without warranties of any kind. Herbal IQ disclaims all express or implied warranties including fitness for a particular purpose or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Herbal IQ’s liability will not exceed $100 or the amount you paid for the Application, whichever is less. We are not liable for indirect or consequential damages.

Severability and Waiver

If any provision is found unenforceable, it will be modified to the extent permitted by law. Failure to enforce any provision does not waive the right to enforce it later.

Product Claims

Herbal IQ is responsible for addressing claims related to the Application, including product liability and legal compliance.

U.S. Legal Compliance

You represent that You are not in a restricted country or on a U.S. government prohibited list.

Changes to this Agreement

Herbal IQ may revise this Agreement at any time. Continued use after changes constitutes acceptance.

Governing Law

This Agreement is governed by the laws of the State of New York, without regard to conflict of laws principles.
